HARARE – Godwin Gomwe, the Zanu PF youth chairman for Harare province, has defied a four-year-old court order to vacate a piece of land he invaded in 2015, according to court papers filed on Wednesday.
Bradha Engineering, the owners of the land accommodating 196 stands in Harare, have asked the High Court to grant an eviction order against Gomwe, three others and two housing cooperatives – Final Hope and Josiah Tongogara.
The three other respondents are Bright Munemo, one Tawanda T, and a Mateyo D.
The land in dispute is located in Westlea, Harare.
“It is four years since the granting of the interim order and the respondents have not complied with the interim order,” said Mawere Sibanda Commercial lawyers representing Bradha.
“The respondents in disregard of the court order have proceeded to construct structures on the land when the court pronounced the land in question shall remain intact.”
The company says there is no indication that Gomwe and team are prepared to leave, with houses still going up in the area after some structures were completed.
In June 2015, Bradha went to court after Gomwe and associates invaded its land – stands 8736 to 8930 – situated in Westlea along Bulawayo and Tynwald Roa.
Bradha won their claim but the invaders have simply ignored the court ruling, the company says.
Gomwe and his associates are yet to respond to the latest court filing.
